The desire of tourists or expatriates to rent a property in Turkey is a strong desire for many reasons, some of them choose the option of renting before ownership to examine living conditions, and some of them are expatriates waiting for an opportunity to work and collect money, so they resort to rent until they can develop their financial situation.

What are the conditions for renting in Istanbul?

  • The lessee must pay the monthly installments on the same date agreed upon in the rental contract.
  • The property tenant in Turkey must have a valid passport.
  • The first installment of the rent, which is a payment of two months, is considered a guarantee for the property owner.
  • The owner has the right to cancel the lease contract, which is specified in the rental contract, and this allows the landlord to vacate the apartment.
  • The names of children under the age of eighteen must be mentioned in the rental contract.
  • The tenant has to pay the monthly bills for the property.
  • Getting the receipt of the paid rental fee.
  • Handing over the rented house as it was in the past without any modification, and in the event that walls and paint colors were conditional in the lease agreement, the tenant has no right to amend any of them.

Payment of the property rent in Turkey:

The Tax Principles Law: The threshold amount for paying the rent of apartments in Turkey through the bank is 500 Turkish liras, as the law punishes those who hand over an amount of money to the owner of the property; in case the payment by hand was proved with evidence, the Turkish law punishes both parties (the owner of the property and the tenant)with a financial penalty of 5% of the amount of money. 

Can the tenant rent out?

The tenant has no right in any way to rent out a property he has leased, regardless of the type of property in question.

The legal text says: Article 322/2: "The tenant does not have the authority to rent the property in any case unless he obtains an authorization registered in the lease contract or a subsequent written approval from the property owner."

What are the duties of a property owner in Turkey:

  • The property owner in Turkey compensates for any shortage or defect in the property if the tenant suffers damage from it.
  • The landlord pays the taxes for the property as long as he does not agree with the tenant that he will pay it when the lease is concluded.
  • If the tenant fails to pay the monthly installment, the property owner has no right to impose a penalty clause on him.

How is a lease contract?

The lease contract consists of two parts:

Section One: contains personal information about the tenant and owner of the property, information about the property, its location and type.

Section Two: contains the general provisions that are legally recognized in addition to some conditions that the parties can agree to add to the contract. Such as: Obliging the tenant to respect the neighbors who live next to him - obligating the tenant to keep the property - the tenant’s lack of entitlement to rent the property - obligating the tenant to vacate the property for the expiry of the contract and not to delay the handing over under any circumstances unless s/he or those living with him are in danger.
